MORNING CALENDAR

 

Appointments

 

Resolution 13-125, CD1 – For adoption by the Council confirming Mark D. Wong as Director of Information Technology for the City.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-126 – For adoption by the Council appointing Carolyn T. Onaga to the Civil Service Commission.

Action Taken:  The Council unanimously adopted the measure.

Resolution 13-127 – For adoption by the Council appointing Cindy S. Inouye to the Civil Service Commission.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-138 – For adoption by the Council appointing Jacce S. Mikulanec to the Grants in Aid Advisory Commission.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-139 – For adoption by the Council appointing Avelino J. Halagao, Jr., to the Grants in Aid Advisory Commission.

Action Taken:  The Council unanimously adopted the measure.

Third Reading Bills

 

Bill 25, CD2 – Consolidates two bills into a single measure prohibiting smoking at all City beaches and parks.

Bill 25, CD2, Proposed FD1 – Removes golf courses from the definition of public parks for purposes of the City’s prohibition on smoking and further that open areas of municipal golf courses are exempted from the prohibition of smoking in certain places.

Action Taken:  The Council amended the measure with Councilmembers Menor and Pine voting with reservations.  The Council approved Bill 25, CD1, FD1 with Councilmembers Menor and Pine voting with reservations.

Bill 28, CD2 – Prohibits smoking at all City bus stops.

 

Bill 28, CD1, Hand-carried FD1 – The amendment changes the effective date of the measure to January 1, 2014.

Action Taken: The Council amended the measure and unanimously approved Bill 28, CD2, FD1.

 

Bill 27, CD2 – Makes all city forms available online for electronic filing or downloading.

 

Bill 27, CD2, Proposed FD1 – Clarifies definitions of certain forms.

Action Taken: The Council amended the measure and unanimously approved Bill 27, CD2, FD1.

Bill 65 (2012), CD1 and Findings of Fact – Adopts the revised ‘Ewa Development Plan for the City and County of Honolulu.  Repeals the existing Development Plan for ‘Ewa, Article 3, Chapter 24, Revised Ordinances of Honolulu 1990, and adopts a new Article 3 incorporating the revised ‘Ewa Development Plan.

Action Taken:  The Council approved the measure with Chair Martin voting with reservations.

First Reading Bills

 

Bill 34 – Amends real property exemptions for charitable purposes.

Action Taken:  The Council unanimously approved the measure for referral to committee and public hearing.

Bill 35 — Initiates the cancellation of the real property tax exemptions for historic commercial real property dedicated for preservation.

Action Taken:  The Council unanimously approved the measure for referral to committee and public hearing.

 

Bill 36 — Adjusts the amount of real property tax exemptions for credit unions.

Action Taken:  The Council unanimously approved the measure for referral to committee and public hearing.

 

Bill 37 — Changes the “hotel and resort” real property class to “hotel, resort and transient” and providing language defining such properties; classifying all real property used as transient vacation units, bed and breakfast units, time share units and fractional ownership units as “hotel, resort, and transient;” changing the property to be classified from “land” to “real property;” and making other housekeeping amendments.

Action Taken:  The Council approved the measure for referral to committee and public hearing with Chair Martin voting no and Councilmembers Anderson, Manahan, Menor and Pine voting with reservations.

 

Bill 38 — Initiates the cancellation of the real property tax exemptions for dedicated lands in urban districts.

Action Taken:  The Council unanimously approved the measure for referral to committee and public hearing.

 

Bill 39 — Adjusts the amount of certain real property tax exemptions for nonprofit hospitals or hospital service associations or societies.

Action Taken:  The Council unanimously approved the measure for referral to committee and public hearing.

Bill 40 — Repeals the in lieu of home exemption.

Action Taken:  The Council approved the measure for referral to committee and public hearing with Councilmember Pine voting with reservations.

 

Bill 41 — Adds “residential-multifamily” as a new general real property class and providing language defining such properties; changing the property to be classified from “land” to “real property;” and making other housekeeping amendments.

Action Taken:  The Council unanimously approved the measure for referral to committee and public hearing.

 

Bill 42 — Adds “Residential A” as a new general real property class and providing language defining such properties; changing the property to be classified from “land” to “real property;” and making other housekeeping amendments.

Action Taken:  The Council unanimously approved the measure for referral to committee and public hearing.

 

Bill 43 — Adds “time share” as a new general real property class and providing language defining such properties; classifying all condominium units used as time share units as “time share;” changing the property to be classified from “land” to “real property;” and making other housekeeping amendments.

Action Taken:  The Council unanimously approved the measure for referral to committee and public hearing.

 

Resolutions

 

Resolution 13-117 – For adoption by the Council to accept a gift to the City from The 200 Club to fund awards for the Honolulu Fire Department’s manager, fire fighter, and civilian employees of the year.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-129 – For adoption by the Council to accept a gift to the City from D.A.R.E. Hawaii for the 2013 Drug Abuse Resistance Education (D.A.R.E.) conference in Cincinnati, Ohio, from July 16 to 18, 2013.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-130 – For adoption by the Council to accept a gift to the City from D.A.R.E. America for the 2013 Drug Abuse Resistance Education (D.A.R.E.) Coordinators’ Meeting in Cincinnati, Ohio, on July 15, 2013.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-133 – For adoption by the Council to accept a gift to the City from the Honolulu Firefighters Foundation for various Honolulu Fire Department projects and events.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-128 – For adoption by the Council to accept a gift to the City from Times Supermarket, Ltd., for the annual Lei Day Celebration at Queen Kapi‘olani Regional Park and Bandstand, Mauna ‘Ala and Kawaiha‘o Church.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-131, CD1 – For adoption by the Council to accept a gift to the City from The National Arts Program Foundation for the Seventh Annual Exhibit and Awards of The National Arts Program for City and County of Honolulu employees and their families.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-132, CD1 – For adoption by the Council to accept of a gift to the City from Nagoya Toyopet to assist in the purchase and installation of flag poles at Honolulu Hale.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-118 – For adoption by the Council to request that the Board of Water Supply explore equitable options for assessing its billing charge.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-143 – For adoption by the Council to urge the City Administration to provide the Friends of Hanauma Bay (“FOHB”) with the necessary financial information regarding the Hanauma Bay Nature Preserve and the Hanauma Bay Nature Preserve Fund to enable the FOHB to conduct and complete long-range planning.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-136, CD1 – For adoption by the Council to grant a Special Management Area Use Permit for the Kaneohe/Kailua Wastewater Conveyance (Tunnel) and Treatment Facilities Improvement Project.  The applicant is the Department of Design and Construction.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-141, CD1 – For adoption by the Council urging the Department of Transportation Services to conduct a traffic analysis of Atkinson Drive.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-142 – For adoption by the Council to authorize the filing of applications and the execution of grant or cooperative agreements with the Federal Transit Administration for Federal transportation assistance authorized by 49 U.S.C. Chapter 53, Title 23, United States Code, and other Federal statutes administered by the Federal Transit Administration (FTA), for Grant Application HI-90-X033.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-121 – For adoption by the Council urging the City Administration to study various planning options to assure uninterrupted operation of childcare services at the Early Education Center.

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-134, CD1 – For adoption by the Council authorizing the Mayor or the Mayor’s designee to enter into an intergovernmental agreement with the State of Hawaii, Department of Health, for the allotment of funds for operating and maintaining a glass recycling program.

Action Taken:  The Council unanimously adopted the meausure.

 

Resolution 13-135 – For adoption by the Council appointing Councilmember Stanley Chang as the Honolulu City Council’s representative to the Hawaii State Association of Counties (HSAC) and designates Council Vice Chair Ikaika Anderson as Chang’s alternate.  Also approves the HSAC slate of officers for Fiscal Year 2013 – 2014:

  • Mel Rapozo (Kauai County Council), President

  • Dennis “Fresh” Onishi (Hawaii County Council), Vice President

  • Stanley Chang (City & County of Honolulu), Secretary

  • Michael Victorino (Maui County Council), Treasurer

 

Action Taken:  The Council unanimously adopted the measure.

 

Resolution 13-145, CD1 – For adoption by the Council authorizing the Chief of the Honolulu Police Department or his duly authorized representative to apply for and to enter into an agreement with the Bureau of Justice Assistance, U.S. Department of Justice, for funds from the Edward Byrne Memorial Justice Assistance Grant Program FY2013 local solicitation.

Action Taken:  The Council unanimously adopted the measure.

Balance of Committee Reports

 

Public Works & Sustainability Committee – For adoption by the Council regarding deeds conveying roadway Lots 18255, 18259 and 16541-B; Grants of Drain Easement 9716 (Lots 18253 and 18256); Grant of Access Easement 9715; and Grant of Street Light Metering Cabinet Easement 9739 for public use in Kapolei.  (Mehana at Kapolei Phase I Subdivision).

Action Taken:  The Council unanimously adopted the report.

 

Public Works & Sustainability Committee – For adoption by the council regarding deeds conveying roadway Lots 511, 67, 81 to 87 inclusive, 88 and 652; Grants of Drain Easements 4, 15, 16, and 21; Grants of Flowage Easement 4, 15, 16, 17, and 21, Grants of Sewer Easements 16 and 19 for public use in Waianae.  (Sea Country 3 and 4 Subdivision and Sea Country Pakeke Street Subdivision)

Action Taken:  The Council unanimously adopted the report.

New Business

 

Resolution 13-151 – For action by the Council regarding a gift from the Nagaoka International Exchange Association to cover the costs of a Councilmember’s trip, including airfare, hotel accommodations, meals, and ground transportation, valued at $1,962, to provide an opportunity for the City to strengthen its Sister City relationship with the government, people and businesses in Nagaoka, Japan, which became a Sister City via adoption of Resolution 12-9, CD1.

 

Resolution 13-151, Hand-carried FD1 – Amends for technical and grammatical accuracy.

 

Action Taken:  The Council amended the measure and unanimously adopted Resolution 13-151, FD1.

 

Resolution 13-157 – The measure was sunshined on to the agenda and renames Kaiaka Beach Park to the Bill and Peggy Paty Kaiaka Beach Park.

Action Taken:  The Council unanimously adopted the measure.

AFTERNOON CALENDAR

 

Appointments

 

Mayor’s Message 100 – Appointing Charles K.Y. Khim as Chair of the Transportation Commission for a term to expire on June 30, 2017.

Action Taken:  The Council referred the nomination to the Committee on Transportation.

 

Mayor’s Message 101 – Appointing Arnold K.H. Wong as a member of the Fire Commission for a term to expire on December 31, 2013.

Action Taken:  The Council referred the nomination to the Committee on Public Safety & Economic Development.

Second Reading Bills

 

Bill 32 – Clarifies City ethics laws to include the transit management services contractor.

Action Taken:  The Council unanimously approved  the measure on 2nd Reading and referred the measure to committee for further public hearing.

Bill 33 – Amends the island-wide fare structure ordinance with regard to the 4-day bus pass.

Action Taken:  The Council unanimously approved the measure on 2nd Reading and referred the measure to committee for further public hearing.

Bill 29 – Repeals the portion of Banyan Street extending from North King Street to Kanoa Street in the Palama District in Honolulu as a pedestrian mall as the underlying parcel was abandoned and the City has conveyed title to the parcel to The Hawaii Conference Foundation, as the abutting fee owner.

Action Taken:  The Council unanimously approved the measure on 2nd Reading and referred the measure to committee for further public hearing.
